Division of old-age pension after divorce or the end of a registered partnership

How is the old-age pension divided?

If you divorce or end a registered partnership, your former partner is legally entitled to half of the pension capital gathered during your marriage or registered partnership.

You and your former partner can agree on a different division. These agreements must be made before the divorce or separation becomes final and must be recorded in a divorce settlement, partnership agreement or marital agreement.

Please note: If you lived together without being married or without a registered partnership, there is no legal right to divide pension.

What do you need to do?

If you live in the Netherlands and your divorce or separation takes place in the Netherlands, we automatically receive notification from the municipality when your marriage or registered partnership ends. We will then inform you and your former partner about the pension division.

You or your former partner must send us the agreed division within two years after the divorce or separation using the Notification Form for Division of Old-Age Pension. This applies both to the legal division and to any different arrangement you have agreed on.

Please note: If you inform us more than two years after the divorce or separation, you and your former partner will need to arrange the division of the pension yourselves.
